## 4. Quotations & Pricing
All prices displayed on this Website, if any, are
indicative only and subject to change without notice.
Formal pricing is issued by quotation only, based on:
- Equipment model, power type, and capacity
- Mast configuration and attachment requirements
- Battery and charger specification (for electric
and lithium models)
- Order quantity
- Shipping terms (FOB, CIF, DDP, EXW, etc.)
- Destination port and country
- Steel, battery material, and currency exchange
rates at time of order placement
Quotations are valid for 30 days from date of issue
unless otherwise stated. A quotation does not
constitute a binding contract until confirmed by
both parties in writing.

## 5. Technical Consultation & Application Suitability
Hebei Maoxiang Technology Co., Ltd. provides technical
consultation to assist buyers in selecting appropriate
equipment. However:
- Final responsibility for confirming that the
selected equipment is suitable for the intended
application, operating environment, and load
requirements rests with the buyer
- We are not liable for equipment being used in
applications, environments, or conditions outside
those stated or reasonably implied at the time
of order
- Buyers operating in regulated industries
(ports, chemical plants, cold storage, food
production, mining, etc.) are responsible for
confirming that equipment meets all applicable
local safety, environmental, and industry-specific
regulations in their jurisdiction

## 6. Certifications & Regulatory Compliance
Our forklifts are manufactured and tested to
international standards and hold the following
certifications:
- CE Marking (Machinery Directive 2006/42/EC) —
for European market compliance
- ISO 9001 Quality Management System certification
**Important — Buyer's Local Compliance Responsibility**
CE certification covers requirements for the
European Economic Area. Buyers importing equipment
into markets outside the EEA are solely responsible
for:
- Confirming that our equipment meets all applicable
local safety standards, import regulations, and
equipment certification requirements in their
country (e.g. OSHA in the USA, CSA in Canada,
AS/NZS in Australia, local type approval in
Gulf states, etc.)
- Obtaining any additional local certification,
type approval, or registration required by
their national or regional authorities
- Ensuring compliance with local emissions
standards for diesel and LPG models
We can provide technical documentation, test reports,
and CE declaration of conformity to support local
approval processes. Additional certification
requirements should be discussed before order
placement.

## 7. Orders & Payment
All orders must be confirmed in writing via email
or signed purchase order. Verbal or informal
agreements do not constitute a binding order.
**Payment Terms**
Standard payment terms for new buyers:
- 30% deposit upon order confirmation and
receipt of proforma invoice
- 70% balance payment before shipment, against
copy of bill of lading and pre-shipment
inspection documents
Adjusted payment terms may be considered for
established buyers or large-volume orders,
subject to prior written agreement.
**Accepted Payment Methods**
- Bank wire transfer (T/T) — preferred method
- Letter of Credit (L/C) — available for orders
above USD 50,000, subject to prior approval
of L/C terms
- Other methods by prior written agreement
Production does not commence until the deposit
payment is received and confirmed by our
finance department.

## 8. Production & Lead Times
Estimated lead times from deposit receipt:
- Standard stock models (counterbalance electric/
diesel, 1–5 ton): 15–25 business days
- Non-stock or custom-configured models:
30–45 business days
- Large capacity models (8 ton and above):
45–60 business days
- Forklift attachments: 15–30 business days
depending on type and quantity
- AGV / AMR autonomous forklift solutions:
lead time confirmed per project scope
All lead times are estimates from deposit receipt.
We will notify you promptly of any material delay
caused by component supply, production scheduling,
or force majeure circumstances.
Chinese public holidays (including Chinese New Year,
typically late January to mid-February) may affect
production schedules. We recommend placing orders
well in advance if delivery timing is critical.

## 9. Shipping & Delivery
We ship to destinations worldwide via sea freight
(RoRo, flat rack, or container) and, where
applicable, by road transport.
- Shipping terms (FOB Tianjin / Qingdao / Shanghai,
CIF, DDP, EXW) are agreed per order and stated
in the proforma invoice and commercial invoice
- Standard export packaging (wooden crate or
container lashing) is included. Fumigation
certificate is provided where required by
the destination country
- Under FOB terms, risk of loss or damage passes
to the buyer upon handover to the carrier
at the named port
- Full export documentation is provided with
every shipment: commercial invoice, packing
list, bill of lading, certificate of origin,
CE declaration of conformity, and operation
manual in English
- Import duties, customs clearance, port handling
fees, local taxes, and inland delivery costs
at destination are the buyer's responsibility
unless DDP terms are agreed in writing
**Oversized & Heavy Equipment**
Forklifts above 7 tons may require flat rack or
RoRo shipping. Buyers are responsible for
confirming port handling capability and inland
transport arrangements for large equipment at
the destination.

## 10. Pre-Shipment Inspection
All equipment undergoes our factory quality
inspection and functional testing before shipment,
including:
- Load test at rated capacity
- Lift and tilt function verification
- Hydraulic system pressure test
- Drive, brake, and steering system check
- Electrical system and safety device verification
- Paint and finish inspection
- Pre-delivery checklist completion
Buyers may arrange independent third-party
pre-shipment inspection at our factory.
Inspection must be scheduled in advance and
all costs are borne by the buyer. We will
provide reasonable cooperation with authorized
inspection agencies.

## 11. Warranty
We provide the following limited warranty
on equipment supplied:
**Standard Warranty Period**
- Forklifts (excluding wear parts): 12 months
from date of delivery, or 2,000 operating
hours, whichever occurs first
- Lithium battery packs: 24 months or
2,000 charge cycles, whichever occurs first
- Forklift attachments: 12 months from
date of delivery
**Warranty Coverage**
The warranty covers defects in materials
and workmanship under normal operating
conditions and proper maintenance as
specified in the operation manual.
**Warranty Exclusions**
The warranty does not cover:
- Normal wear and tear (tires, brake pads,
filters, fuses, bulbs, seals, belts)
- Damage caused by misuse, overloading beyond
rated capacity, improper operation, or
failure to follow the operation manual
- Damage caused by unauthorized modification,
repair, or use of non-approved spare parts
- Damage caused by accidents, collision,
fire, flood, or other external causes
- Consumables (engine oil, hydraulic oil,
coolant, battery electrolyte, LPG)
- Equipment operated in environments or
applications not disclosed at time of order
- Corrosion damage in high-humidity,
chemical, or marine environments unless
specific anti-corrosion specifications
were agreed at order stage
**Warranty Claim Process**
Warranty claims must be submitted in writing
to admin@maoxiang-mach.com with:
- Equipment model and serial number
- Date of delivery and hours of operation
- Description of the fault with photographs
or video evidence
- Maintenance records
We will assess the claim within 10 business
days of receipt of complete documentation.
Approved warranty claims will be resolved
by supply of replacement parts (at our cost,
buyer pays freight) or, in exceptional cases
at our discretion, by equipment replacement
or repair credit.
We do not cover labor costs for warranty
repairs unless a prior written agreement
for on-site warranty service has been made.

## 12. Spare Parts & After-Sales Support
We maintain spare parts inventory for all
current production models and provide:
- Spare parts supply for a minimum of 5 years
after the model's end of production
- Technical support via email and WhatsApp
for fault diagnosis and repair guidance
- Operation manuals and parts catalogues
in English supplied with every unit
Spare parts orders are subject to separate
quotation and standard payment terms.
Lead time for spare parts is typically
7–21 business days depending on part
availability and shipping method.

## 13. Safety & Operator Responsibility
Forklifts and material handling equipment
are inherently hazardous machinery. By
placing an order, the buyer acknowledges
and agrees that:
- All equipment must be operated only by
trained, qualified, and (where required
by local law) licensed forklift operators
- The buyer is solely responsible for
ensuring that operators receive appropriate
training before operating the equipment
- The buyer is responsible for conducting
pre-shift safety inspections as described
in the operation manual
- The buyer must not modify or alter the
equipment in any way that affects its
structural integrity, rated capacity,
or safety systems without written
approval from us
- The buyer is responsible for compliance
with all applicable workplace safety
laws, regulations, and standards in
their jurisdiction (including but not
limited to OSHA, HSE, or equivalent
local authority requirements)
We are not liable for any injury, death,
property damage, or third-party loss
arising from improper operation, inadequate
operator training, unauthorized modification,
overloading, or failure to follow the
operation manual and applicable safety
regulations.

## 14. Claims & Defects
Written claims for equipment defects,
specification deviation, or shipping
damage must be submitted to
admin@maoxiang-mach.com within 14 days
of the confirmed delivery date.
All claims must include:
- Order number and invoice reference
- Equipment serial number
- Description of the defect or damage
with photographs or video evidence
- For shipping damage: note of protest
from the carrier or port authority,
and marine insurance claim reference
if applicable
Claims submitted after 14 days, or
without the required documentation,
may not be accepted.
We are not liable for:
- Minor cosmetic damage (paint chips,
surface scratches) caused during
ocean freight or container loading
that do not affect equipment function
- Damage caused by the buyer's own
unloading, handling, or storage after
delivery
- Performance issues resulting from
operation in conditions outside those
specified at order stage

## 15. Returns Policy
As a manufacturer of made-to-order and
configured-to-specification industrial
equipment, we do not accept returns of:
- Equipment built or configured to
buyer's specific requirements
- Equipment that has been commissioned,
operated, or modified after delivery
- Equipment that has left China and
cleared customs at the destination
Returns of unmodified, unoperated equipment
may be considered in exceptional circumstances
by prior written agreement only. Unauthorized
returns will not be accepted and will be
held at the buyer's cost and risk.

for fraud, wilful misconduct, death or
personal injury caused directly by our
negligence, or any liability that cannot

## 19. Force Majeure
Neither party shall be liable for failure
or delay in performing obligations where
such failure results from circumstances
beyond reasonable control, including:
acts of God, war, civil unrest, pandemic,
government restrictions, steel or
component supply disruptions, port
closures, power outages, or carrier
strikes.
The affected party must provide written
notice as soon as practicable. Both
parties agree to cooperate in good faith
to minimize impact and resume performance
at the earliest opportunity.
If a force majeure event continues for
more than 60 consecutive days, either
party may terminate the affected order
by written notice, with payment due
for all work completed and materials
procured to that date.

## 20. Governing Law & Dispute Resolution
These Terms & Conditions are governed
by the laws of the People's Republic
of China.
In the event of a dispute, both parties
shall first attempt resolution through
good-faith negotiation within 30 days
of written notice.
If negotiation fails, the dispute shall
be submitted to the China International
Economic and Trade Arbitration Commission
(CIETAC) for final and binding arbitration.
Place of arbitration: Beijing, China.
Language of arbitration: English.
The arbitral award shall be final and
